Acknowledgement: Owner commissions Supreme Cervidae Marketing to sell the contracted consignments to the highest bidder at public auction. Owner certifies that he is the owner and that he has clear title and the right to sell them. Owner acknowledges that it is impossible to predict with any certainty the prices which will be received for auctioned items. Accordingly, no such representation is made by Supreme Cervidae Marketing.
Fees: Owner agrees to pay Supreme Cervidae Marketing a commission of 10% of the gross receipts of all sales made of all consignments during the period of the contract whether such sales are made at public auction, by private treaty or in any other manner. A full commission shall be due and payable to Supreme Cervidae Marketing immediately following the completion of each sale whether the sale is made in cash or on terms determined by the Owner. If Owner shall breech this agreement, or remove consignment after publicity has been printed, Owner agrees to pay the commission as above provided. Commission amount will be based on market value of consignment.
Payment: The net proceeds of consignment due Owner will be paid to Owner fourteen (14) days after the sale of the consignment or when buyers check clears auction company’s bank. Owner will not receive proceeds on any consignments sold until buyer has paid for them.
Descriptions: All descriptions that appear in the catalog and advertising have been described by the Owner. Supreme Cervidae Marketing assumes no liability for errors or omissions.
**All reasonable efforts must be made by the Owner to ensure the accuracy of the information provided for each lot consigned.
Guarantee & Contract: Representations and guarantees are strictly between the individual Owner and the buyer. Supreme Cervidae Marketing makes no representation of warranty, expressed or implied, on the animal or semen as to their merchantability or their fitness for general or particular purpose, and do further state the animal or semen to be sold “as is”, and without recourse. The contract of sale is between the Owner and the buyer. Supreme Cervidae Marketing is acting as owner’s agent only.
Possession: Seller will maintain possession of his animal or semen sold until delivered or buyer picks up the animal or semen and full payment is made.
